This document is Amiba’s privacy policy that covers existing Amiba customers. Amiba respects the privacy of its existing and prospective customers. This privacy policy describes how we collect and use information we receive from existing customers.

Existing customers are those who have entered into an agreement to receive Amiba’s products and services.

Prospective customers are those who have not yet entered into an agreement to receive Amiba’s products and services.

Amiba is committed to respecting our customers’ and prospective customers’ privacy. Once you choose to provide personally identifiable information, it will only be used in the context of our customers’ and prospective customers’ relationships with Amiba. Except as noted below, Amiba will not sell, rent, or lease your personally identifiable information to others. Amiba will only share the personal data you provide with other Amiba entities and/or business partners who are acting on Amiba’s behalf to provide you services, as described and limited below. These Amiba entities and/or national or international business partners are governed by Amiba’s privacy policies with respect to the use of this data.

Amiba offers voice, video, mobile, and unified communications solutions for businesses of all sizes. In specific, Amiba offers a portfolio of SaaS solutions encompassing hosted communications services, contact centre, unified communications, video web conferencing, managed dedicated hosting, virtual private servers and more. Amiba has been delivering cloud services since 2013. Amiba customers include sole traders, small to medium-sized businesses, distributed enterprise organizations and government agencies.

    4. Providing Notice to Customers

The purpose of this Privacy Policy is to inform customers about the kinds of information Amiba collects about them, how it collects that information, the purposes for which it uses information about them, how to contact Amiba with any inquiries or complaints, the types of third parties to which it discloses the information, and the choices and means Amiba offers individuals for limiting its use and disclosure.

    5. Information We Collect and How We Collect It

At the time a business becomes a customer, Amiba may already have collected information about that business when it was a prospective customer.

We gather information from prospective customers through a variety of ways, online and through offline communications, which include in-person meetings, web forms, emails, and phone calls. We collect contact information from representatives of our prospective business customers, such as name, company name, address, email address, and telephone number. As we communicate with these representatives, we may gather additional information from them, such as the potential customer’s industry or revenues. We may also use data-appending methods to gather additional information, such as by reviewing biographical information posted by these representatives on the Internet. We also gather information about representatives’ communications preferences.

In addition, we gather information based on prospective customers’ systems and behaviour in viewing our website pages and files on our website, including what pages or files are viewed, when users view them, the time spent on each page, browser and operating system, Internet Protocol address, the domain associated with that address, and location. We also collect information based on prospective customers’ behaviour in opening and viewing emails, such as whether a user opens an email and how long it is viewed. We collect information about prospective customers’ behaviour on our website and in viewing of emails by logging it and the use of beacons.

Following is an overview of information collected by our Android app and the purpose for which we collect it.

android.permission.ACCESS_NETWORK_STATE

Allows applications to access information about networks. Used by app to know if we are connected on WiFi or 3G.

android.permission.INTERNET

Allows applications to open network sockets. Used by app to open a socket back to the PBX.

android.permission.MODIFY_AUDIO_SETTINGS

Allows an application to modify global audio settings. Used by app to set and read volume settings.

android.permission.READ_CONTACTS

Allows an application to read the user’s contacts data. Used by app to display contacts, for use with the long press on the Green handset button, allowing dialling of contacts for the app.

android.permission.READ_EXTERNAL_STORAGE

Allows an application to read from external storage. Used by app to store debug log file, and server connection details.

android.permission.WRITE_EXTERNAL_STORAGE

Allows an application to write to external storage. Used by app to store debug log file, and server connection details.

android.permission.READ_PHONE_STATE

Allows read only access to phone state, including the phone number of the device, current cellular network information, the status of any ongoing calls, and a list of any PhoneAccounts registered on the device. Used by the app to know if there is a GSM call in progress or incoming allowing the app to act accordingly.

android.permission.RECEIVE_BOOT_COMPLETED

Allows an application to receive the ACTION_BOOT_COMPLETED that is broadcast after the system finishes booting. Used by the app to know when the phone had rebooted and allowing the app to auto start.

android.permission.RECORD_AUDIO

Allows an application to record audio. Used by the app to gain access to the MIC for voice calls

android.permission.VIBRATE

Allows access to the vibrator. Used by the app for notification of incoming calls.

android.permission.WAKE_LOCK

Allows using PowerManager WakeLocks to keep processor from sleeping or screen from dimming. Used by app to control wake state while on a call.

Finally, Amiba gathers information from users of its website. Amiba uses cookies to gather information from visitors. We use this information to analyse how visitors use our website and to better match their experience with our website with their interests. Amiba also gathers information concerning the search terms which website visitors have used to reach our website.

After a prospective customer becomes a customer, we continue to maintain the information collected during the time in which it was a prospective customer. We also collect additional information from prospective customers that become customers using the means we describe above.

For instance, once prospective customers enter into a service agreement with Amiba, we collect and maintain information about customers’ agreement with Amiba, payment information, and information about individual transactions. Also, we collect information needed to deliver online services, support, and training to customers. For example, we gather information to register customers to use our services, such as a user name and password for each individual account.

Calls with Amiba’s Sales, Customer Service and other Amiba employee groups may be recorded to gather information to improve customer service. However, Amiba’s policy is that no call or conversation will be recorded unless all those involved in the call have been made aware in advance that the call is going to be recorded. Customers have the options of stating their consent to be recorded, implying consent by staying on the call, or opting out by asking that their call not be recorded or just hanging up.

Moreover, we collect information that you or others provide to us in connection with your use of our services. Examples include phone numbers you dial or provide to our services, service set-up information, service configurations and settings, recorded calls, messages, and meetings, voicemails, incoming and outgoing faxes, user-saved or stored content shared among users, email and text communications, and call center customer information you provide to us. Our systems also generate reports and information stored on your account. We maintain this system-generated information in connection with your account.

Children are not eligible to use Amiba’s website and services, and we ask that minors (under age eighteen) not submit personally identifiable information to us.

    6. Sharing and Transfer of Information (Onward Transfer)

Some information that we collect and store under this policy may be in the possession

of third parties that we use for the delivery of Amiba’s products and services and data processing. We require these third parties to protect that information with the same privacy and security controls that apply to our own collection, storage, and use of the information.

Disclosure of data will only be made to third parties who are our agents or servants acting on our directions.

Under no circumstances will lists of customer data/information (i.e. mailing lists or database information) be disclosed to a third party for that third party’s exploitation or use without your express permission, with the exception of what we are required to do by law, for example in a criminal investigation. We reserve the right to share or transfer your information if we believe that such sharing or transfer is required under applicable law.

We reserve the right to share or transfer your information in connection with a future or actual sale, merger, reorganization, or other transfer of our business (including under bankruptcy proceedings).

Finally, we reserve the right to share any information that is not personally identifiable information, such as aggregated information without personally identifiable elements and any de-identified or anonymized information. For instance, Amiba is required to file numerous reports with different administrative bodies. When we do so, Amiba may provide aggregate statistics about customers, sales, and traffic patterns. None of these reports or statistics will include personally identifiable information.

Except as set forth above, it is Amiba’s policy not to share with third parties any information that we collect under this policy without your permission. Amiba’s business does not include selling or renting any lists of customers, prospective customers, or their representatives.

    7. How We Use the Information We Collect

We use the information collected from customers to complete transactions with us, such as by billing the customer. We also use contact and transactional information to deliver equipment and other products purchased by the customer. In addition, we provide online services and control access to these services, with information such as user names and passwords.

More generally, Amiba uses the information collected from a customer to deliver the products or services purchased by the customer. For instance, the information we collect enables us to deliver to customers SaaS solutions encompassing hosted communications services, contact centre, unified communications, video web conferencing, managed dedicated hosting, virtual private servers, and other services.

Also, we use the information we collect in order to communicate with our customers and offer them other products and services. We may also use gathered information to communicate with customers in order to respond to their inquiries and provide training and support. We may communicate with customers’ representatives by electronic communications, such as emails, newsletters, and white papers; postal mail; and phone calls.

We also reserve the right to use information we collect to investigate and help prevent unlawful or potentially unlawful activity that threatens either Amiba, any company affiliated with Amiba, or any of our respective customers.

We retain information about former customers until we delete their information under our document retention and deletion practices.

    8. Security: How We Safeguard the Information We Collect

Amiba uses industry-standard administrative, technical, and physical safeguards to protect the confidentiality of the information we collect under this policy from security threats that we reasonably can anticipate. Amiba’s security safeguards protect the confidentially, integrity and availability of information collected under this policy to assure its reliability for its intended use and to protect it from loss, misuse, and unauthorized access, use, disclosure, alteration, or destruction.

    9. Data Integrity and Your Ability to Access or Change Information

Amiba uses information collected under this policy for the purposes for which it has been collected, as described in more detail in Section 7 above. In addition, Amiba implements practices to ensure that such information is accurate, complete, and current, including the procedures below that allow you to access or change information about you in our possession.
